CCI supports the free
flow of information and ideas over the Internet. We offer our
subscribers the means to acquire and disseminate a wealth of
public, private, commercial, and non-commercial information.
However, the fundamentals of the Internet are that no one,
neither CCI nor the general public owns, or controls it.
Therefore, we take great responsibility on fully informing our
subscribers of their rights along with their obligations, and
those of CCI in connection with their use of the Internet. CCI
does not actively monitor nor exercise editorial control over
the contents of any Web site, electronic mail transmission,
mailing list, newsgroup as well as other materials created, or
accessed utilizing CCI Services. Therefore, CCI cannot vouch
for the accuracy and quality of the information obtained.
However, CCI reserves the right to remove from our servers any
materials that, in CCI's sole discretion, are potentially
illegal / may subject CCI to liability, or violate this User
Acceptance Policy. Your violation of this Policy may result in
the suspension or cancellation of your CCI Services. This
agreement includes our subscribers along with their affiliates
or subsidiaries. This Policy should be read in conjunction
with CCI Net, Inc., Internet Service Agreement.
The following constitute
violations of CCI's Policy:
Using a personal account for high volume or
commercial use. In the event that you would like to establish
/ utilize a commercial account or a high volume account,

subscribers with personal accounts include, but are not
limited to:
1) Personal Dial-Up
- Total allotted Web and Mailbox
space exceeding 10MB, will be temporarily blocked at CCI's
discretion. To reactivate them, subscribers should contact

- Posting as well as email scams
such as 'make-money-fast' schemes or 'pyramid/chain'
letters.
- Exceeding 250MB of traffic in a
one-month period for free Web sites. Any Web site exceeding
250MB of traffic will be billed for the excess traffic.

Business Hosting
- Subscribers exceeding their
allotted Web space and bandwidth will be charged

- Sales and promotion (e-Commerce)
of materials of indecent, and unlawful nature such as
pornographies as well as lawfully prohibited merchandize.
The following constitute as
legally prohibited activities:
Should CCI services be utilized for illegal purposes or in
support of illegal activities, CCI reserves the right to
cooperate with legal authorities and/or injured third parties
in the investigation of any suspected crime / civil wrong.
Activities prohibited as potentially illegal include, but are
not limited to:
Distribution / Transmission of
Obscene or indecent Speech / Materials
Transmitting obscene or indecent speech / materials over
the Internet. Disrupting any newsgroup with frivolous,
excessive vulgarity, or repetitious postings. Violations of
this nature may result in civil / criminal actions according
to both Federal / State laws.
Spamming
Subscribers acknowledge that they are expressly prohibited
from utilizing CCI's Service, equipment, or any email address
in connection with sending the same / substantially similar
unsolicited email message, whether commercial or not, to a
large number of recipients. This prohibition extends to
unsolicited mass mailings from another service, which in any
way implicates the use of CCI's Service, equipment, or email
addresses. A message is unsolicited if it is posted in
violation of a USENET or newsgroup charter and/or if it is
sent to a recipient who has not requested or invited the
message. For purposes of this provision, merely making one's
email address accessible to the public shall not constitute a
request or invitation to receive messages.
Subscriber specifically agrees that he/she will not utilize
CCI's Service, equipment, or any email addresses in connection
with the transmission of the same or substantially similar
unsolicited message to 50 or more recipients or 15 or more
newsgroups in a single day. A Subscriber responsible for these
acts may be terminated at CCI's discretion. For each day upon
which this provision is violated, Subscriber agrees to pay CCI
$10.00 per email for an unintentional violation of this
provision. CCI at its sole discretion shall determine whether
such a violation was unintentional or willful. Payment by
member under this provision shall not prevent CCI from seeking
to obtain other legal remedies against member, including other
damages or an injunction.
Copyright violations
Unauthorized copying of CCI copyrighted materials
including, but not limited to duplication, and distribution of
digitized materials as well as other copyrighted sources, and
software will result in legal actions against the subscriber.
Export Control Violations
Exporting software or technical information in violation
of U.S. exports control laws. This law limits the ability of
subscribers to export encrypting software, over the Internet,
to destinations outside the United States. This will result in
civil / criminal liability under Federal and State law.
Security Violations
Attempt to gain illegal / unauthorized access of
computers, or network carriers ( "hacking"), as well as
penetrate security measures of CCI Network. This will result
in civil and criminal penalties under both Federal / State
laws.
Password Control
Revealing your account password to others or allowing the
usage of your account by others (other than authorized users
in your household). The same username and password should not
be used simultaneously at any time. This will result in legal
actions taken against the account holder.
Act of Forgery
Forging any message header, in part or whole, of any
electronic transmission, originating or passing through CCI's
Service. This will result in civil / criminal liability under
both Federal and State laws.
Distribution of Viruses / other
destructive activities
Distributing Internet viruses, worms, Trojan horses, or
other destructive activities. This will result in serious
civil / criminal liability under Federal and State law.
Newsgroup Control
Cross-post advertisement products, items, or services to ten
(10) or more unrelated USENET newsgroups. Post articles to any
USENET or other newsgroup, mailing list, or similar forum,
which are off-topic according to the charter or other public
statement of the forum. Posting binary, or excessively large,
unrelated text files to non-binary newsgroups that have
specifically requested such material not be posted in the
group's FAQ (Frequently Asked Questions), charter or other
public statement of the forum that such material not to be
posted. Installation of 'auto-responders,' 'cancel-bots,' or
similar automated or manual routines which generate excessive
amounts of Net traffic, or disrupt Net newsgroups / email use
by others. Failure to follow these will face legal actions
taken against them according to both Federal and State laws.
Unlimited Service
Subscriber acknowledges that CCI's Service is intended for
periodic, active use of email, user newsgroups, file transfers
via FTP, Internet chat, Internet games, and browsing the World
Wide Web. Subscriber further agrees not to use the Service on
a standby or inactive basis in order to maintain a connection.
Pinging is expressly prohibited. Accordingly, CCI maintains
the right to terminate Subscriber's connection following any
extended period of inactivity as determined by CCI. Usage of
software or any device that would allow your account to stay
logged on while you are not actively using CCI's Service is in
violation of this Service Agreement. Also utilizing the
account for the purpose of operating a server of any type is
not permitted. This will result in legal actions against the
account subscriber.
Liability
CCI has no practical ability to restrict all conduct,
communications, or content which might violate this Policy
prior to its transmission on CCI's systems. Also CCI cannot
ensure prompt removal of any such communications or content
after transmission or posting. Accordingly, CCI does not
assume liability to Subscribers or others for any failure to
enforce the terms of this Policy.
Other Activities
Any activity whether lawful or unlawful, which is
determined by CCI to be harmful to it's subscribers,
operation, or reputation. Engaging in any of the above
activities using the services of another provider but
channeling such activities through a CCI account, or using it
as a mail drop for responses.
Policy Revisions
CCI reserves the right to amend, alter, or modify this Policy
at any time, and in any manner. Any amendment, alteration, or
modification is effective immediately after reflecting on
CCI's Web site
